National Human Rights Commission of Korea Issues Recommendations on Deaths of Inpatients in Mental Health Facilities

The National Human Rights Commission of Korea (hereinafter referred to as the 'Commission') announced recommendations for several institutions related to the death of an inpatient at 00 Hospital in △△ City, Gyeonggi Province, following a thorough investigation into the incident.
Firstly, the Commission requested the Prosecutor General to investigate the hospital director, attending physician, on-duty physician, nurses, and nursing assistants at 00 Hospital for allegedly instructing and aiding in the falsification of medical records. The Commission concluded that the hospital's medical staff had falsified patient medical records or failed to take appropriate actions.
Furthermore, the Commission recommended the Mayor of △△ City in Gyeonggi Province to thoroughly supervise and oversee 00 Hospital to prevent similar incidents from recurring and emphasized the need for a thorough review of illegal isolation and coercive measures imposed on victims.
The hospital director was advised to conduct job training regarding violations of isolation and coercion guidelines and falsification of medical records and to establish and enforce clear working regulations for on-duty medical staff. The Commission pointed out that responsible measures within the hospital are necessary to prevent human rights violations.
Lastly, the Commission issued recommendations to the Minister of Health and Welfare. They requested an amendment to the Mental Health and Welfare Act to make it mandatory for inpatients in mental health institutions to have face-to-face consultations with psychiatric specialists before coercive measures are taken. Additionally, they recommended the establishment of an obligation for the notifying of protective duty holders when coercive measures are imposed on inpatients in the Enforcement Rules of the Mental Health and Welfare Act.
