전북특별자치도의회 교육위원회 윤영숙 의원(익산3)이 대표 발의한 「전북특별자치도교육청 노동인권교육 진흥 조례안」이 지난 7월 25일 제420회 임시회 본회의에서 원안 가결됐다. 이번 조례 제정을 통해 향후 도내 학교에서 노동인권교육이 보다 체계적이고 실효성 있게 시행될 기반이 마련됐다.

조례에는 노동인권교육의 기본원칙 명시, 교육감 및 사용자의 법적 책무 규정, 연간 교육계획 수립과 실태조사 의무화, 학생노동인권교육위원회 설치, 표준지침 개발 및 교원 직무연수, 전담 인력 및 재정지원, 유공자 표창 제도 등 다양한 실행 조항이 포함돼 있다.

해외에서도 청소년 대상 노동인권교육은 다양한 형태로 운영되고 있다. 독일은 직업교육훈련(VET) 체계에서 노동법, 근로계약, 노사관계 교육을 학교와 실습기업에서 병행하며 권리와 의무를 실질적으로 체득하게 하고 있다. 프랑스는 중·고등학교 시민교육과정에 노동시장 구조와 근로계약 내용을 포함하며, 고등학교에서는 근로계약서를 직접 작성해보는 수업도 운영된다. 미국은 주별로 청소년 노동권 보호 교육을 시행하고 있으며, 특히 캘리포니아주는 ‘Teen Workers’ Toolkit’ 등을 통해 근로조건, 안전, 차별 대응 등의 내용을 학교 수업과 연계해 안내하고 있다.

국내에서도 서울, 경기, 광주 등 일부 시·도교육청이 비교적 일찍부터 노동인권교육을 제도화하고 운영해왔다. 서울시교육청은 노동인권교육 전담팀을 운영하며 모의 근로계약 실습, 상황극, 청소년노동 상담 등 체험 중심 교육을 실시하고 있으며, 다문화 학생을 위한 영문·중문 자료도 제작했다. 경기도교육청은 2015년 조례 제정 이후 노동인권 실천학교 지정, 교원 직무연수 확대, 실태조사 기반 정책 설계를 통해 교육의 실효성을 높이고 있다. 광주광역시교육청은 인권전문강사단과 웹툰·영상 기반의 학년별 맞춤형 수업을 운영 중이다.

전북의 조례는 이들 시도의 교육 구조와 유사한 내용을 포함하고 있으며, 특히 사용자 책무를 법제화하고 전담 예산 확보를 명시한 점에서 제도적 실효성을 강조한 것이 특징이다.

이번 조례 제정에 대해 전북 지역 교육계는 실질적인 노동인권교육 기반이 마련됐다는 점에서 긍정적인 평가를 내놓고 있다. 청소년인권 관련 시민단체들 또한 노동권 교육이 청소년 권리 인식과 보호의 중요한 출발점이 될 수 있다며 환영의 뜻을 밝혔다. 일부 인권단체는 시행 과정에서 학생 참여와 현장 의견 수렴이 충분히 이뤄져야 한다고 강조하고 있다.

전북교육청은 조례에 따라 노동인권교육 표준지침을 마련하고, 희망 학교를 대상으로 연간계획에 따라 프로그램을 운영할 예정이다. 교원 직무연수 확대와 실태조사 정례화를 병행하고, 교육 신청 시스템과 교육자료 배포 체계도 함께 구축해 나갈 방침이다.

윤영숙 의원은 “청소년들이 노동현장에서 정당한 권리를 인식하고 주장할 수 있어야 하며, 이를 통해 안전한 지역사회를 만들어갈 수 있다”며 “교육청과 학교, 지역사회가 함께 협력해 실효성 있는 정책으로 이어지도록 지속적으로 보완해 나가겠다”고 밝혔다.

The "Jeonbuk Special Self-Governing Province Education Promotion Ordinance for Labor Rights Education" proposed by Yun Young-sook, a member of the Education Committee of the Jeonbuk Special Self-Governing Province Council (Iksan 3), was approved in the main session of the 420th interim session on July 25. Through this ordinance, a foundation has been laid for more systematic and effective implementation of labor rights education in schools throughout the province.

The ordinance includes basic principles of labor rights education, regulations on the legal responsibilities of the superintendent and employers, mandatory annual education planning and surveys, establishment of a student labor rights education committee, development of standard guidelines, teacher training, dedicated personnel and financial support, and a commendation system for contributions, among various implementation clauses.

Youth labor rights education is being operated in various forms overseas as well. Germany integrates labor law, employment contracts, and labor relations education into its vocational education and training (VET) system, allowing students to effectively grasp rights and obligations in schools and practical training companies. France includes labor market structures and employment contract contents in its middle and high school civic education curriculum, with classes where high school students directly create employment contracts. The United States conducts youth labor rights protection education at the state level, with California particularly guiding students on labor conditions, safety, and discrimination through school classes and resources like the "Teen Workers' Toolkit."

In South Korea, some city and provincial education offices like Seoul, Gyeonggi, and Gwangju have institutionalized and operated labor rights education relatively early. Seoul Metropolitan Office of Education operates a dedicated team for labor rights education, conducting experiential education such as mock employment contract practices, role-playing, and counseling for youth labor, and has produced English and Chinese materials for multicultural students. Gyeonggi Provincial Office of Education, since the enactment of the ordinance in 2015, has designated labor rights practice schools, expanded teacher training, and designed policies based on survey data to enhance the effectiveness of education. Gwangju Metropolitan City Office of Education operates tailored classes by grade level based on webtoons and videos with a team of human rights experts.

The Jeonbuk ordinance includes content similar to the education structures of these regions, emphasizing institutional effectiveness by legalizing employer responsibilities and specifying dedicated budget allocation.

The education community in Jeonbuk has positively evaluated the establishment of a practical foundation for labor rights education through this ordinance. Civil organizations related to youth rights have welcomed the labor rights education as an important starting point for youth rights awareness and protection. Some human rights organizations emphasize the need for sufficient student participation and on-site opinion collection during the implementation process.

Jeonbuk Education Office will establish standard guidelines for labor rights education according to the ordinance and will operate programs for target schools based on annual plans. They plan to expand teacher training and formalize survey practices, while also building an education application system and distribution system for educational materials.

Assembly member Yun Young-sook stated, "Youth should be able to recognize and assert their legitimate rights in the workplace, which can help create a safer local community," and expressed her commitment to continuously improve policies in cooperation with the education office, schools, and local communities to ensure effective implementation.
